Requirements for a Notary Republic

Notaries public are certified professionals who verify the identities of people signing important legal and financial documents. The requirements for a notary public vary from state to state, however there are some general guidelines to know. Being aware of the general guidelines will help you decide if being a notary public is an option for you.

General Requirements

    States generally have very basic requirements before someone can even consider being a notary public. These include being a resident of the state, being 18 years of age or older, and having a clean criminal record. Citizenship is not a requirement, and residency is based on what state you claim as your primary residence on federal and state tax forms. When filling out the paperwork to become a notary, you will have to attest to the fact that you meet all of these requirements. Providing false information in this regard is an act of perjury.

Training Requirements

    In addition to meeting basic criteria, several states require that aspiring notaries have formal training provided by the state or private parties. For example, the state of California requires that all those seeking appointments as notaries take a six-hour course. This course is required no matter how many times a person has received notary appointments in the past, however a three-hour course is available for notaries seeking renewal before the expiration of their license. Notary courses seek to educate potential notaries in their responsibilities and duties, standardize the knowledge set for all notaries public, and reduce the amount of complaints filed against notaries.

Record Requirements

    Notaries public are generally required to keep record books of their work. These records are kept in a standardized record book. Many states, such as Texas, require that records be kept whether the notary is paid for her work or not. Record books require information such as dates, names and contact information for signatories, descriptions of the document and what it refers to, and the name and contact information for any witnesses.

Military Requirements

    Commissioned officers in the United States military have a federally mandated right to notarize documents. However, this is a restricted right to notarize. Military notaries may notarize documents only for other members of the military and their immediate family members.

Seal Requirements

    Seal requirements vary by state, but states generally require that all notarized documents be sealed. One example of a notary seal is the Texas notary seal requirement that all seals have a specific symbol, the name of the notary and the date the notary commission expires.
