Advance Directives Vs. Power of Attorney
An advanced directive is a document that allows you to make a decision in advance of the need for that decision. A power of attorney, on the other hand, is a document that gives somebody else the right to make a decision for you.
Generally
Advance directives and powers of attorney are common estate planning documents that help you plan ahead for times when you are unable to make your own decision. The way they accomplish this goal, however, differs significantly.
Power of Attorney
A power of attorney is a legal authorization that you give to somebody else, called your attorney or agent, to make decisions for you.
Advance Directive
An advance directive is a document in which you write down your orders on what to do in certain situations in case you are for some reason unable to make a decision at that time.
Types
The most common two types of advance directives and powers of attorney are for health care and finances. For example, an advance health care directive instructs your family and physicians on what to do with you in case you wind up on life support.
Time Frame
Advance directives and powers of attorney both typically don't have any effect until you become mentally incapacitated or otherwise unable to make your own decisions. For example, if you are in a car crash and end up in coma then your financial power of attorney will allow your agent to take care of your property, pay for your medical treatment, and otherwise manage your finances while you are unable to.
