How to Obtain Power of Attorney in Pennsylvania
If you want to receive power of attorney in Pennsylvania, you must comply with some very specific state laws. Pennsylvania power of attorney (POA) laws not only make provisions for how each party must sign the document, but also what specific language must be included. Failing to comply with these laws may make the power of attorney invalid, so be sure you take the proper steps to ensure the POA is properly formatted for Pennsylvania law.

Put it in writing. Pennsylvania only allows for written grants of power of attorney. You do not need to write the document yourself, but it must be in writing.
2Include the required notice. Pennsylvania Code section 5601 requires all powers of attorney to include a notice at the beginning of the document. (See Resources for a sample POA with the required notice.)
3Name the parties. Your power of attorney must name the person giving away the decision making ability, known as the principal, and the person receiving it, known as the agent or attorney-in-fact.
4Detail durability. Unless otherwise stated, all Pennsylvania powers of attorney are presumed to be durable. This means the power of the agent continues even if the principal becomes unable to revoke the POA or is otherwise incapacitated. If you want your POA to be non-durable, make this clear in the document.
5Notarize the document. The principal must notarize the POA document in Pennsylvania, though the agent does not have to. However, the agent must sign and attest to specific language required by law. This must also be included in the POA document.
