The Average Lawyer Fees for Chapter 13

The Average Lawyer Fees for Chapter 13

In 2005, Congress made filing for bankruptcy harder, such as increasing the filing fees for a Chapter 13 debt restructuring to $274, according to Money Zine. Legal fees for handling a Chapter 13 are much more expensive and depend on the complexity of your case.

Retainer

Most lawyers charge between $500 and $1,000 for the retainer -- the upfront fee -- to take your Chapter 13 bankruptcy case, according to Bills.com. This is subtracted from your final bill.

Attorney Fees

Lawyer fees make up the bulk of a Chapter 13 case. The Government Accountability Office finds that the typical lawyer charges $3,000 for a Chapter 13 bankruptcy.

Considerations

Attorneys charge their clients by the hour, not by the type of case, so your actual fees can be much less or greater than $3,000, suggests Bills.com. Consult with attorneys about fees before starting a case -- some may offer a reduced payment based on your income.
