Who Do I Report Government Fraud to in Arkansas?

In the state of Arkansas, the Arkansas State Claims Commission, also referred to as the ASCC, is the investigatory and quasi-judicial body created by the General Assembly to provide a venue for those who have been injured or damaged by the State of Arkansas.

Soveriegn Immunity and The State Of Arkansas

    Under Article 5, Section 20 of the constitution of the the State of Arkansas, the State cannot be sued in any state court under the principle of sovereign immunity. The provision reads, in part, that Arkansas "shall never be made a defendant in any of her courts."

Getting Around Sovereign Immunity

    The General Assembly created the arms length ASCC as a means of maintaining sovereign immunity while getting around it when justice demands. The Commission was deemed the best way the State could maintain immunity from the courts and still fulfil a constitutional requirement to "provide for the payment of all just and legal debts of the State."

Filing a Complaint

    Filing a complaint with the commission my be done online or by regular mail. You may be represented by a lawyer if you wish or you can file the complaint on your own. Filing procedures are available on the Commission website.
