Notary Signature Line Information
The laws governing the duties, responsibilities and formalities of a notary public vary from one state to the next, but the general rules are the same. One area that the law focuses on is the notary public signature line and what information must be included in that space.
Function
The functions of a notary public include administering oaths and authenticating documents. A typical component of the authentication or verification process involves the notary signing legal documents of different types.
Signature Clause
A signature clause accompanies the signature line itself used by a notary public. The common language used in the signature clause reads something to the effect of "subscribed and sworn to before me on this 1st day of May 2008." The clause advises that person executing the document did so in front of a notary public in the manner permitted by law.
Commission Expiration
The notary signature line includes the date that the commission of the notary public expires. Laws vary from state to state regarding how long a notary public's appointment lasts. A typical term is five years. The language regarding commission expiration can be as simple as "my appointment expires October 4, 2012."
Stamp or Seal
An appropriate stamp or seal must be included at or near the signature line at the time a notary public signs a document. Most states permit a notary to use an ink stamp to apply the insignia of her office. A raised seal involves the use of a hand-held device that imprints onto the document itself a three-dimensional impression. The laws in most states require the seal to contain basic information, including the name of the notary public and the date of his commission's expiration. On the other hand, Texas is an example of a state with precise instructions on the appearance of a notary stamp. Included on the Texas stamp must be a five pointed star, the Lone Star design featured on the state's flag.
Signature
Upon the conclusion of an oath or a verification of the document, the notary public affixes her own signature onto the signature line itself. Although some notaries public have been tempted to use a signature stamp, this is not permissible in any jurisdiction. Notaries public must apply their signature by hand.
