Alberta Family Law Information
Family Law in Alberta, Canada is a complex and comprehensive area of law that involves everything from marriage to divorce to children and everything in between. Family Law Information Centres are provided by Alberta Justice to supply information on topics such as the various Acts upheld by the province, and include details on laws such as child support payments and grounds for divorce.
Family Law Act
Proclaimed on October 1, 2005, the Family Law Act is a law system that promotes the well-being of families and children. It protects the best interests of children and helps to reduce emotional stress and financial costs of a family breakdown. It outlines court procedures, but also supports resolving conflicts outside of a courtroom. It does not address various matters under the Child, Youth and Family Enhancement Act, the Minor's Property Act, the Matrimonial Property Act or the Divorce Act.
Marriage
A marriage license must be purchased from a registered agent. It is valid only in Alberta and is valid for only three months from the issue date. A registration for marriage must be completed and signed as well. A marriage certificate is legal proof of a name change. Marriage participants must be at least 18 years of age and not related to each other. They must also be unmarried and show proof of divorce if they had been previously married.
Divorce
The Parliament of Canada has created a federal law called the Divorce Act that all provinces adhere to. Only three grounds for divorce are acceptable. The first is if the two parties have been separated for a year, but may include a attempted reconciliation period that has lasted no more than 90 days. The second reason is if adultery has been committed without being condoned by the harmed individual. The third ground is if one person has treated the other with intolerable cruelty, whether it be physical or emotional.
Birth and Adoption
Upon birth of her child, a mother or both parents will complete a Registration of Birth, showing her as the biological mother. When a child is adopted, a new Registration of Birth is completed by the adoptive parent(s) and the original is removed and sealed away. When the parents are married, at least the father must sign the Registration of Birth. A Social Insurance Number may be applied for on the same Registration of Birth form with no fees attached.
Child Support
A "child of the marriage" shall be supported by both spouses at least until the age of 18 if ordered to do so by the court in accordance with the Divorce Act. Child support must still be paid in some cases when the child is over 18, such as if the order was granted under the Divorce Act or the Family Law Act and the child is a full-time student under 23. Conversely, some court orders may dictate the specific date or age of the child at which child support may be stopped.
