California Notary Public Certification
A notary witnesses legal and business documents and administers oaths under the jurisdiction of her state government, according to the National Notary Association, a trade group. Notaries verify the identity of signers of an agreement, deed or document and indicate that they properly signed and executed the document by affixing a seal. Once a California notary public completes the certification process, the California state government sends a certification packet and official commission.
Education
All notaries in the state of California must complete a six-hour course approved by the California Secretary of State for the training of notaries public before taking the certification exam, according to the California public code. The California Secretary of State maintains a database of approved providers of notary education, and these providers offer both classroom and online training programs to meet the education requirement. Classroom sessions usually take place in one six-hour session; online training programs are available to complete either in one sitting or in multiple sessions. Notary educational courses usually feature an overview of the services a notary must provide, the legal foundation for these services and the public responsibilities a notary undertakes by performing these services. Costs for notary courses vary, but you can expect to pay between $45 and $75 for a course.
Certification Exam
The California Secretary of State's office oversees the exam scheduling process; after completing the mandatory educational course, you can schedule your certification exam through the Secretary of State's notary portal. California contracts with a test vendor with locations throughout the state to offer the exam in as many cities as possible. The two-hour, multiple choice examination is a closed-book test of your knowledge of the services a notary performs and the legal background for these services. First-time test takers will pay $40 to take the exam; all others pay $20 for the test. You will receive your test results approximately 15 days after you take the test. California requires a score of at least 70 percent to pass the notary certification exam.
Background Check
Applicants for California notary service must submit fingerprints for a background check. The California Department of Justice conducts the check through its LiveScan fingerprinting service, available in nearly every community in California. When you visit your local LiveScan location, bring a background check request form from the Secretary of State's notary portal, photo identification and processing fees. The California Department of Justice provides a schedule of fees with its directory of LiveScan locations, since every location charges a different fee to perform the fingerprint scan and background check. The California Department of Justice checks your fingerprints for any criminal records and transmits your fingerprints to the Federal Bureau of Investigation as well for a similar check.
Materials
The California Secretary of State's office sends notaries who pass the exam and the background check official certification and a commission as a notary. Included with the certification and commission information are instructions for purchasing materials necessary for service as a notary---a notary journal, a public seal and a $15,000 surety bond. Notaries in California must record all instances where they notarize documents in a notary journal. The Secretary of State provides a list of approved state vendors who manufacture official seals of the state of California; each notary must purchase her own seal from a vendor of her choice. The California Notary Handbook notes that a surety bond provides funding to cover any claims against the notary by her clients. Although there is no time limit to purchase a notary journal or a seal, California law requires that notaries file the surety bond within 30 days of receiving their commission.
Filing an Oath
California state law requires that notaries must file an oath of office with the clerk of the county where they do business, according to the California Secretary of State. The California Notary Handbook recommends that notaries file the mandatory $15,000 surety bond and their oath of office at the same time, since their county clerk must receive both filings. Notaries must file their oath of office and surety bond within 30 days of receiving a commission to become a California notary public. Although California law allows for notaries to file their oath and bond by mail, the California Secretary of State's office recommends that notaries file these documents in person to ensure timely processing.
