Georgia Family Law Information
Georgia families with impending divorces or family disputes should learn about their rights under state law. Family law cases generally go through the Superior Courts of Georgia as civil actions.
Divorce
Georgia allows couples to divorce based on irreconcilable differences or on at least one of the state's 12 fault grounds. An individual must meet the state's residency requirement for filing a divorce, as well as file in the appropriate Georgia county.
Child Custody
In child custody disputes, the Georgia Superior Courts will determine custody based on the child's best interests. However, the court may allow a child over 14 years of age to indicate any preferences about where to live. The court will try to maintain both parents' relationships with their child, whenever appropriate.
Parenting Plans
Under Georgia law, divorcing couples who have children must develop detailed parenting plans covering physical custody, child-rearing decisions and major aspects of the child's life such as education, health and religion.
Child Support
The state calculates child support obligations based on both parents' gross incomes. The Georgia Department of Human Services oversees child support in the state through the Division of Child Support Services. The agency will help families with all aspects of child support, including enforcement, collection and distribution.
