How to Hire a Workers' Compensation Lawyer

When you are injured at work, a workers' compensation lawyer can help. In a perfect world, your employer would pay your workers' comp claim without the need for you to hire a workers' compensation attorney. Unfortunately, this does not always happen and if your claim is denied, you will need a qualified workers' compensation attorney to protect your rights. Contact the state bar association, as it lists information like the attorney's background, specialty and law school. Once you have a few names, interview several attorneys and come prepared with a list of questions.

Ask about past cases. Although past performance is not a guaranteed indicator of future results, a lawyer should have a strong history of representing clients.

Ask about professional background, experience and legal skills. How long has he been practicing? How many workers' comp claims does he handle in a year?

Ask about approach to communication and decision-making. Make sure you feel comfortable with the lawyer.

Understand the types of fees that the workers' compensation lawyer will charge. Many attorneys charge a percentage of the settlement that you will receive. This means that you have to pay a portion of the money you recover. State law often mandates upper limits on what attorneys can charge and has other specific rules for how an attorney can collect fees. Also find out how much your workers' compensation attorney will charge if your claim is denied, if you have to have an appeal hearing, and/or if you have to appeal the decision of the Worker's Compensation board.
