Asbestos Notification Requirements

Asbestos, once a common material in siding, insulation, and other commercial and residential building components, has been linked to Mesothelioma, as well as other health conditions and problems. Mesothelioma is a type of cancer that destroys the lining of the lungs, stomach, and abdomen and is associated almost exclusively with exposure to asbestos. Since the health risks associated with asbestos became known to the public, laws have been enacted that mandate the disclosure of the presence of asbestos in both public and private buildings.

Commercial Buildings

    Commercial building owners in all states are required to post notices informing employees and visitors of the presence of asbestos and the associated health risks of exposure. Disclosure and notification laws for public buildings vary by state. In some states, only businesses with 30 or more employees are required to post public disclosure notifications.

Residences

    Homeowners are not required to disclose the presence of asbestos unless they decide to sell their homes. Every state has laws requiring the notification and disclosure of asbestos by home sellers to home buyers. It is especially important for sellers to disclose the presence of asbestos to potential buyers if the asbestos has become broken or damaged, since this can lead to the release of toxic particles in the air.

Removal Notifications

    The National Emissions Standards Hazardous Air Pollution Act has strict regulations regarding the removal of asbestos. The EPA considers the removal of asbestos to be the most hazardous form of asbestos abatement, and recommends professional sealing of asbestos whenever possible. When removal is necessary, a professional asbestos abatement service must be used, and notifications of the removal of asbestos from public buildings must be posted.
