Types of Power of Attorney Forms
Power of attorney is an arrangement in document form that gives someone the power to act as an agent with specific powers and decision-making abilities for another, referred to as the principal. Various power of attorney forms cover different aspects of the principal's life; financial, health and general conditions. Power of attorney forms can assign limited, general or durable powers over to the agent.
General Power of Attorney
General power of attorney forms hand over authority to do whatever the principal does or did. All decisions and business are done by the agent. General financial power of attorney: allows the agent to transact any or all business other than health care for the principal. This should be done only after careful consideration. The validity of this document ends upon incapacitation or death.
Durable Power of Attorney
Durable power of attorney forms directs the agent to continue to act for the principal after the principal is incapacitated. This power of attorney ends at death and goes into effect after signing. All decisions are made by the agent as with the general power of attorney; the difference being that the durable directive carries on through the incapacitation.
Health Care Power of Attorney
Health care power of attorney forms hand all health-related decisions to the agent who acts in the best interests of the principal, making decisions based on a living will or other directives. States differ in some of the restrictions or abilities in a health care power of attorney; some require living wills and directives.
Limited Power of Attorney
Limited power of attorney is a condition used in the case of guardianship of a child or if a child requires directives from someone other than his parents. What schools the child will attend, health decisions for the child and other instances might require a limited power of attorney. These documents usually have a specific end time. Incarcerated parents might hand over limited power of attorney to their child's caregiver.
Military Power of Attorney
Military power of attorney puts into effect special provisions for military personnel. The Armed Services Legal Assistance Office can answer any inquiries regarding this type of power of attorney. Military power of attorney is recommended before deployment so military spouses and family have directives should the need arise.
