What Does a Litigation Attorney Do?
Attorneys practice in many areas of the law, but the public is most familiar with litigation attorneys. Often referred to as "trial lawyers," litigation attorneys represent clients in all stages of a lawsuit.
Before Suit
Litigation attorneys do a great deal of work before filing suit. This may include gathering evidence, legal research, counseling the client and attempting settlement. Due to the expense of civil trials and the risk inherent in criminal trials, many cases settle without the filing of a lawsuit.
Pretrial Matters
A great deal of work exists between filing suit and going to trial. Litigation attorneys file required pleadings, seek to discover evidence from the other side, file and argue motions and take depositions of important witnesses. They also maintain communication with opposing counsel and prepare the client and all their witnesses for trial.
Trial and Post-Trial Proceedings
Litigation attorneys represent the client in actual courtroom proceedings from motions to the actual trial. This requires detailed knowledge of rules of evidence and trial advocacy. Often, a litigation attorney will also take responsibility for handling any appeals their client may be entitled to make.
