What Do Labor Lawyers Do?
Labor lawyers became well known during the height of the labor union movement in America. Many labor lawyers today still represent labor unions, but they may also represent individuals or a wide variety of companies that wish to stay in compliance with the law.
Legal Education
All lawyers must complete a four-year undergraduate degree before proceeding to law school. In law school, they will study the basic tenets of the law in the United States and will receive a juris doctorate at completion. Lawyers are also required to pass the bar examination in the state where they intend to practice law.
Specialty training
A labor law lawyer will generally take elective classes in law school to gain a broader education in the area of labor law. They will also take continuing legal education classes in the area of labor law. If the state where they practice allows, they will become certified as a specialist in a particular area of labor law.
General duties
A labor lawyer practices civil law. They will be responsible for understanding the state and federal statutes that pertain to labor law as well as case law pertaining to labor law. They may also need an in-depth understanding of contract law as many middle and upper level employment positions are based on an employment contract.
Working for an employer
Some labor lawyers will work for an employer. Companies frequently employ labor lawyers to keep them abreast of changes in the laws and to advise them on employment contracts or labor disputes.
Working for employees
Other labor lawyers choose to work for employees. Many work for unions that represent hundreds or thousands of employees. A labor union lawyer will advise the employees on contract negotiations and disputes as well as represent an employee if they have an individual dispute with their employer. Other labor lawyers work for individual plaintiffs that feel they have been discriminated against or otherwise injured by an employer.
