Florida Lemon Law Information
Florida's Lemon Law applies to new cars and demonstrator vehicles that are sold or leased long-term. Under this law, car manufacturers must replace defective vehicles or refund consumers' money under certain circumstances.
What's Covered
The law covers defects that significantly impair the use, value or safety of a new car or demonstrator vehicle. The defects must be reported to the manufacturer or the dealer during the first two years after the car was delivered to the consumer.
Defect Notification
If a vehicle is in and out of the repair shop for 15 or more days or has been back to the service agent at least three times in an attempt to repair the same recurring problem, the owner can file a motor vehicle defect notification with the manufacturer (not the dealer).
Final Repair
After the manufacturer receives the defect notification, he has 10 days to direct the consumer to another repair shop and another 10 days to fix the vehicle.
Replacement
If a vehicle is out of service for a total of 30 or more days, a consumer may be eligible for a refund or a replacement vehicle.
Arbitration
If the manufacturer doesn't provide a refund or a replacement, consumers may seek arbitration. If the manufacturer has an arbitration program certified by the state at the time the vehicle was purchased, the dispute must be submitted there first.
Final Resolution
If the manufacturer has no state-certified program or consumer isn't satisfied with the program's decision, the dispute must be submitted to the Florida New Motor Vehicle Arbitration Board. If the board decides the vehicle is a "lemon" the consumer is awarded a replacement vehicle or a refund that includes costs.
