A single person can earn $52,597 or less, $68,075 for a family of two, $80,344 for a family of three, and $96,695 for a family of four. For each additional family member, the state of Virginia allows an additional $6,900.
2Evaluate chapter 13 bankruptcy. Chapter 13 bankruptcy doesn't focus on eliminating your debts, but instead allows you a longer period of time for repayment. But to qualify for this type of bankruptcy you must have a reliable income with cash left over after paying monthly bills. The state of Virginia doesn't allow more then $1,010.650 in secured debt when filing this type of bankruptcy.
3Consider hiring an attorney. If managing the bankruptcy process yourself seems overwhelming, you may want to hire an attorney. State Lawyers is a company that provides a directory of bankruptcy attorneys in the state of Virginia.
4Complete your bankruptcy forms. The United States Bankruptcy Court of Virginia has both chapter 7 and 13 bankruptcy forms available online. Print, complete and mail the forms to the address listed on the forms. The filing fees range from $200-$300.
5Attend a court hearing. Once you file the necessary paperwork, you will receive a certified letter from the bankruptcy court requesting your presence at a hearing. When attending the proceeding, creditors and the Virginia court appointed trustee will have an opportunity to ask you questions.
