How to File for Divorce Without Going to a Lawyer in Michigan

Going through a divorce can be a stressful time--all the more so when cost is taken into consideration. The average cost of a divorce in a major city can be as much as $18,000. But you can decrease this significantly if you file for divorce yourself. You can file for divorce without an attorney, but in Michigan, you'll have to take specific steps to do it correctly. Since there is no specific divorce complaint form recognized by the Michigan Supreme Court, you need to know what to do before you file your divorce.

    Visit your local courthouse and check to see if divorce petition forms are available there. You can ask the court clerk to help locate them, or, if the courthouse has a law library, ask the librarian. Fill out these forms with the appropriate biographical information. However, the courthouse may not be provide a uniform divorce complaint form, so you may have to go elsewhere.

    You can find sample Michigan divorce complaints online. Several websites have free examples you can copy and paste into a word processing program. (See Resources.) With others, you can fill out the information online and the properly completed form will be emailed or sent to you via postal mail.

    You'll need to fill in the appropriate information, including you and your spouse's legal names, your residence, your spouse's residence, where and when you were married, whether or not you have children, and the statement of dissolution.

    The key section to your complaint is your statement of dissolution--your assertion that the divorce is no-fault. To do that you have to affirm the following: "A breakdown of the marriage relationship to the extent that the objects of matrimony have been destroyed, and no reasonable expectation exists that the marriage can be preserved." It is important you state this language exactly, as it is specified by the law, and failure to do so may make your complaint invalid.

    No matter how you create the divorce complaint, you'll need to make sure everything you write is correct, and then you'll have sign it before a notary, affirming what you have written is the truth. Once that is finished, file your complaint with the clerk and schedule your court date.
