Spain: Immigration Laws

In 2007, Spanish immigration laws changed quite drastically in favor of the immigrant. Immigration to Spain can be done through limited means with the best, most assured route being obtaining solid work and a work permit from the government, which will allow you to stay much longer. To buy yourself time, take courses at a university with a student visa. Before you apply for citizenship, set up residency for at least 10 years. Declare political asylum or refuge to get your application in five years. Prove you have Spanish heritage and get your Spanish citizenship in only one year. Verify eligibility for a non-lucrative residency permit if you want to live in Spain but not become a citizen.

Residency

Set up residency in Spain as your first step to immigrating fully into the Spanish nationality. Get into the country through a tourist visa at first if no work is available to you. This permit lasts for 90 days. Reapply out of country if your visa expires. Once work is secured, acquire a work visa. Employers typically apply for work visas for you to expedite the process. A work visa in Spain allows you to stay for as long as you hold the job. Buy or rent a home to establish an address. Bypass the process if you are a European national. European nationals need no work permit to work in Spain. Show your employment contract and automatically obtain a residency permit.

Stay Awhile

Determine how long you need to prove residency for, depending on your situation. A non-European national, with no exceptions, is required to wait 10 years before putting in an application for citizenship in Spain.

Shorter Routes

Apply after five years if you have been granted political refuge or asylum. Get your citizenship after two years of residing in Spain if you are previously a citizen of the Philippines, Equatorial Guinea, Andorra, any Latin American country, Portugal or a Jew of Spanish origin. Apply for citizenship after only one year of residency if you were born in Spain, have a Spanish parent or are married (or were married) to a Spanish citizen.

Non-Lucrative Permit

Take an easier route to living in Spain by proving you have $75,000 in the bank with an additional $15,000 for each family member. Obtain your non-lucrative residency permit this way, which allows you to stay, but not work in Spain. Buy a home in Spain before you apply to make sure you fit all the requirements. Retain your citizenship elsewhere, but live in Spain as long as you'd like.

More Red Tape

Present all required documents with your application for citizenship. This includes your birth certificate, your marriage certificate (if necessary) and your parents' birth and marriage certificates. All documents must be translated into Spanish. Turn in a certificate from the police stating your good conduct and statements from two Spanish citizens that support your character and application. Show that you are integrated into the Spanish culture. Hire a lawyer, because there is a lot of paperwork involved.
